PUD dated 09.12.2021 has been received for extension of time.
In CRRFC No.9/2018, this Court by judgment dated 26.07.2021
had remanded the matter with certain directions and it was also
directed that the Trial Court shall complete the trial within a period of
four months.
In PUD dated 09.12.2021, the Trial Court has given the details
of steps taken by it in detail. The crux of the matter is that the
statement of the accused under Section 313 of Cr.P.C was recorded on
03.12.2021 and he sought time to lead defence evidence, and
accordingly the case was fixed for 09.12.2021. On 09.12.2021 also, he
sought time to lead evidence, and accordingly, case was adjourned to
13.12.2021.
Since this PUD is dated 09.12.2021, therefore, it is not known as
to what has transpired after 13.12.2021, By this PUD, the Trial Court
has sought further time of three months to conclude the trial. More
than a month has already expired from PUD dated 09.12.2021, and
accordingly, the time to decide the trial is extended by a further period
of two months from today. The Trial Court shall positively decide the
trial latest by 20.03.2022.
With aforesaid observation, the PUD is finally disposed of.
The Registry is directed to immediately communicate this order
to the Trial Court for necessary information and compliance.
