         Heard through Video Conferencing.

         Shri D.D. Bansal,learned counsel for the appellant.
         This is the second appeal at the instance of plaintiff against reversal
judgment and decree dt.05.03.2020 passed by 1st Additional District Judge,
Guna in Civil Appeal No.400016/2016.
         The trial Court has found the plaintiff in possession of the suit land.

The First Appellate Court while allowing the counter claim decreed the claim
of declaration of the defendant over the suit land as patta holder though no
patta is on record and further directed for recovery of possession from
plaintiff in absence of prayer in the counter claim.
         In such circumstances, issue notice to the respondents by both modes

on payment of process fee within three working days, failing which this appeal shall stand dismissed without further reference to the Court.

Notice be made returnable within four weeks. Until further orders, parties are directed to maintain status quo, as it

exists today.
