                           during winter vacation.
                                 For the reasons mentioned in the application, same is hereby allowed.
                                 Also   heard    on   the   question    of   admission       as   well as   on

                           I.A.No.23717/2022.
                                 Issue notice to the respondent on payment of process fee within seven

working days by both modes.

Notice be made returnable within four weeks. The applicant is challenging the impugned judgment dated 01.12.2022 delivered by the Additional Sessions Judge, Special Court, Electricity Act, Jabalpur in Criminal Appeal No.183/2022 whereby the Criminal Appeal under Section 374(3) of the Cr.P.C preferred by the applicant against the judgment dated 05.08.2022 passed by the learned trial Court has been disposed of by

modifying the sentence imposed upon the applicant, but arbitrarily enhanced the fine amount from Rs.1,56,000/- to Rs.1,70,000/- in complaint case No.SCNIA 4009434/2014.

It is contended by the learned counsel for the applicant that the amount of Rs.32,000/- approximately has already been deposited in the Court below.

As an interim measure, if the applicant deposits 50% of the fine amount i.e. Rs.1,70,000/- within a period of one week from today before the trial Court, the effect and operation of the impugned judgment dated 01.12.2022 so far as it Signature Not Verified Signed by: VINOD SHARMA Signing time: 12/23/2022 12:28:06 PM

relates to consequential action in the event of non-payment of compensation, shall remain stayed till next date of hearing.
