IN THE HIGH COURT OF MADHYA PRADESH
AT JABALPUR
MCRC No. 6592 of 2016
(JAVED ALI PRADHAN Vs SHEIKH MOHAMMAD IZAZ (NANHE))
Dated : 25-04-2022
Mr. Umesh Trivedi, learned counsel for the petitioner.
Mr. Sanjay Sharma, learned counsel for the respondent.
Learned counsel for the petitioner submits that one of the main grounds for challenging the proceedings in this case under Section 138 of the Negotiable Instruments Act is on the ground of territorial jurisdiction. He submits that three years after the M.Cr.C. was filed before this Court, the law stood change and as
on date, it can be filed where the complainant resides and the cheque was put in for encashment and therefore, he prays that he wants to go through the case laws to assess whether the judgment will be applicable retrospectively or prospectively.
Under the circumstances, list his case on "Top of the List on 13.07.2022". Interim relief to continue till the next date of hearing.
