   RESPONDENT/RESPONDENT:

          NEELIVEETTIL ACHUTHAN, AGED 74 YEARS ,S/O. KADUKUZHIYIL APPU, DOING
          BUSINESS, ELATHURAMSOM, KARANNURDESOM, ERANHIKKAL POST, KOZHIKODE
          TALUK - 673 303.

        Application praying that in the circumstances stated in the
   affidavit filed therewith the High Court be pleased to stay the operation
   and execution of judgment and decree passed by the Additional District
   Judge III, Kozhikode in AS.NO.92/2019 dated 22.12.2020 and all further
   proceedings, pending disposal of the above second appeal.
        This Application again coming on for orders upon perusing the
   application and the affidavit filed in support thereof and this Court's
   order dated 26.07.2021 and upon hearing the arguments of M/S.C.P.MOHAMMED
   NIAS, S.AJITH (PALAKKAD), V.NAMITHA, Advocates for the petitioner and of
   M/S.K.M.FIROZ & SHAJNA M., Advocates for the Respondent, the court passed
   the following:
