For the Appellant(s): Mr. Rahul Pandey, Advocate. For the State : Mr. Shailendra Kr. Tiwari, Spl. P.P.

-----

06/20.11.2025: By filing this interlocutory application, the appellant renewed his prayer to suspend the sentence and release him on bail during the pendency of this appeal.

2. The appellant has been convicted in connection with Children Case No. 08/2021, arising out of Doranda P.S. Case No. 211 of 2020 for the offence under Section(s) 376(DA) IPC and Section 4/6 of POCSO Act. He has been sentenced to undergo rigorous imprisonment for twenty years and fine of Rs.10,000/- under Section 6 of the POCSO Act and other punishment for other offences.

3. Heard the learned counsel for the appellant and learned Special P.P for the State and have gone through the impugned judgment, the evidence and the Trial Court Records.

4. Opportunity was given to the State to oppose the bail, which the State availed and opposed.

5. The appellant is renewed his prayer for bail. Prayer for bail of the appellant was earlier rejected by a reasoned order. Again, we have gone through the evidence of the victim, which clearly supports the prosecution case. There is no fresh ground to re-consider the prayer for bail of the appellant. The custody is also only three and half years. Thus, we are not inclined to release the appellant on bail.

6. Accordingly, I.A. No. 14583 of 2025 is dismissed.
