09 /18.11.2025: I.A. No.9545 of 2025 This is second attempt of the appellant for suspension of sentence. The earlier application for suspension of sentence is dismissed by this Court. By filing this interlocutory application, the appellant renewed his prayer to suspend the sentence and release him on bail during the pendency of this appeal.

2. The appellant has been convicted and sentenced in connection with Special (POCSO) Case No. 23 of 2020, for the offence under Section(s) 376AB and 354A of the Indian Penal Code and Sections 6 and 10 of the POCSO Act. He has been sentenced to undergo rigorous imprisonment for life and fine of Rs. 25,000/- under Section 6 of the POCSO Act.

3. Heard, the learned counsel for the appellant and learned A.P.P. for the State and have gone through the impugned judgment, the evidence and the Trial Court Records.

4. Opportunity was given to the State to oppose the bail, which the State availed and opposed.

5. The victim is aged about 12 to 13 years. She has been examined as P.W.-1. She supported the prosecution case stating that this appellant has committed rape upon her. The medical report also suggests sexual assault. The other witnesses have also supported the prosecution case and the fact that the victim was raped. We are not dealing in details with the evidence so that it may not prejudice.

6. Considering the aforesaid material, we are not inclined to release the appellant on bail.

7. Accordingly, I.A. No.9545 of 2025 stands dismissed.
