Learned counsel for the appellant-petitioner submits that this interlocutory application has been filed with the prayer to condone the delay of 154 days in filing this acquittal appeal. It is next submitted by the learned counsel for the appellant-petitioner that learned counsel for the appellant before the appellate court below could not inform the appellant about disposal of the appeal; the judgment of which has been impugned in this acquittal appeal. Hence, the delay has occurred. It is then submitted that the appellant-petitioner has very good ground to agitate in the acquittal appeal and unless the delay in filing the acquittal appeal is condoned, the appellant-petitioner will be highly prejudiced. Hence, it is submitted that the delay of 154 days in filing the instant acquittal appeal, be condoned.

Learned counsel for the respondent No.2 submits that the appellant-petitioner is deliberately delaying the proceeding of this appeal to harass the respondent No.2.

Considering the facts and circumstances of the case, the delay of 154 days in filing this acquittal appeal is condoned subject to payment of cost of Rs.5,000/- by the appellant to the respondent No.2 through the learned counsel appearing in the record within two weeks from this date of this order; failing which, this Interlocutory Application shall stand dismissed without further reference to the Bench and this acquittal appeal shall stand dismissed, being the barred by limitation.

This interlocutory application is disposed of accordingly.

Learned counsel for the respondent No.2 submits that the appellant be directed to serve the copy of the appeal memo along with the annexures.

Learned counsel for the appellant submits that the same will be supplied to the respondent No.2 within two weeks.

List this appeal after filing of the proof of payment of cost of Rs.5,000/- by the appellant to the respondent No.2 through the learned counsel appearing in the record.
