2. This is an application filed by the petitioner praying for grant of anticipatory bail under Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending his arrest for the offences under Sections 498-A of IPC, in connection with Complaint Case No.556 of 2023, pending in the Court of learned A.C.J.M., Giridih.

3. This case arises out of complaint. Petitioner is the husband. The allegation against this petitioner is that he has tortured and demanded dowry from his wife.

4. Since this case arises out of complaint. There is no question of investigation.

5. In view of the aforesaid facts, I direct the petitioner to appear before the Court concerned. Once the petitioner appears the Court will pass an appropriate order, in view of the judgment passed by the Hon'ble Supreme Court in the case of Satender Kumar Antil vs. Central Bureau of Investigation & Another, reported in (2022) 10 SCC 51 as well as observation made in the case of Satender Kumar Antil vs. Central Bureau of Investigation & Another, reported in (2021) 10 SCC 773 and file necessary bonds to the satisfaction of the Court, subject to condition that till the final report is submitted, the petitioner will appear before the I.O. once in every 15 days and further to ensure that if the trial progress and if the chargesheet is filed, the Court will start the proceeding in terms of Sections 262/263 of BNSS within a period of one month, thereafter. The petitioner should also give an undertaking that he will not linger the trial. If there is any deviation from the aforesaid conditions, if will be open to the Trial Court to cancel the bail bonds of the petitioner and will take necessary action against him.

6. Accordingly, the instant anticipatory bail application stands disposed of.
