05/30.07.2025 After some arguments, learned counsel for the petitioner seeks

permission to withdraw this petition with liberty to take all the grounds before

the learned Court in the miscellaneous case. He submits that the execution

case is being prolonged and in view of that, the learned Executing Court is

required to decide the same at the earliest in light of the judgment passed in

the case of Rahul S. Shah v. Jinendra Kumar Gandhi and others,

reported in (2021) 6 SCC 418.

2. Learned counsel for opposite party no.2 has got no objection and he

submits that opposite party no.2 will co-operate before the learned Executing

Court for disposal of the said miscellaneous petition.

3. In view of the above, this petition is permitted to be withdrawn and

disposed of with the aforesaid liberty.
