03/09.09.2024 Issue notice to the informant.

2. Learned A.P.P is directed to get the notice served upon

the informant/victim through the Superintendent of Police, Chatra

in terms with the judgment rendered by the Hon'ble Supreme Court

in the case of "Nipun Saxena & Anr. Vs. Union of India"

reported in 2019 (2) SCC 703.

3. The fact regarding service of notice upon the

informant/victim shall be brought on record by filing a

supplementary affidavit before the next date of listing.

4. Put up this case under appropriate heading on

16.10.2024.

5. Meanwhile, learned A.P.P shall also procure the case

diary from his end.

6. Till then, no coercive step shall be taken against the

petitioner in connection with POCSO Case No. 30/2023, arising out

of Itkhori P.S. Case No. 29/2023, pending in the court of learned

Special Judge, POCSO Act, Chatra.
