1. The instant criminal revision has been filed against the judgment dated 01.08.2023 passed in Criminal Appeal No.02 of 2023 by the court of learned Sessions Judge, Hazaribag, who has affirmed the judgment of conviction and order of sentence dated 30.11.2022 passed by the learned A.C.J.M., Hazaribag in Complaint Case No.2107 of 2017 whereby and whereunder the petitioner has been convicted for offence under Section 138 of the N.I. Act and has been sentenced to undergo simple imprisonment for one year and to pay fine of Rs.4,00,000/- as compensation to the complainant.

It has been submitted by the learned counsel for the revisionist that the money has already been transacted between the parties and the matter has already been compromised outside the Court and this fact has been brought on record by way of filing an interlocutory application being I.A. No.8461 of 2024.

3. Considering the fact that the matter has already been compromised between the parties, the judgment dated 01.08.2023 passed in Criminal Appeal No.02 of 2023 by the court of learned Sessions Judge, Hazaribag and the judgment of conviction and order of sentence dated 30.11.2022 passed by the learned A.C.J.M., Hazaribag in Complaint Case No.2107 of 2017 are, hereby, quashed and set aside.

4. The present criminal revision application stands allowed and disposed of.

5. In view of disposal of the present criminal revision, I.A. No.10010 of 2023 filed for exemption from surrender in the Court below and another

interlocutory application being I.A. No.8461 of 2024, are hereby allowed and accordingly disposed of.

6. The revisionist is exempted from surrender in the learned Court below.
