This application has been filed by the applicant seeking condonation of delay of 128 days in filing this appeal challenging the judgment of learned Single Judge.

2. Though, the private respondent has filed a counter affidavit seriously contesting the application for condonation of delay, since the delay is not inordinate. On payment of cost of Rs. 3,000/- to the private respondent within four weeks, the said period of delay is condoned and the instant Interlocutory Application is allowed. In default of making such payment, the instant Interlocutory Application as well as appeal shall stands dismissed.
