It has been submitted on behalf of the appellant that the in the appeal arising out of the same judgment, i.e., Criminal Appeal (DB) No.606 of 2023, the L.C.R. has been called for and the interlocutory application filed under Section 389(1) Cr.P.C. has been directed to be heard after receipt of the L.C.R., therefore, prayer has been made that this case may also be tagged with aforesaid criminal appeal.

Such submission has been made in present of learned counsel appearing for the opposite party - State.

Considering the same, let this appeal be listed along with Criminal Appeal (DB) No.606 of 2023.

I.A. No.4147 of 2023 The prayer for suspension of sentence of the appellant made in the instant interlocutory application will be considered after receipt of the Lower Court Record.
