Mr. Abhijeet Tushar, the learned Amicus informs the Court that on complaint made by the petitioner CP Case No. 1086 of 2009 was instituted.

The learned Amicus states that the brother of Shampa Sen Gupta informed him last evening about her death.

The learned Amicus refers to the judgment in "Praban Kumar Mitra v. State of West Bengal & Anr." AIR 1959 SC 144 to submit that even on death of the complainant the present petition irrespective of its nomenclature shall survive.

The learned Amicus shall seek instructions from brother of the petitioner for filing an application for substitution.

Post this matter on 18th November 2022.
