17/21.11.2022 Mr. Prabhat Kr. Sinha, learned counsel assisted by Ms. Ranjana Singh, learned counsel submits that following issues are involved in this appeal:-
1. Whether the amended provisions can be implemented with retrospective effect to in the instant case or not ?
2. Whether limitation of 18 years has been given go-bye by the learned Tribunal, before passing impugned Award ?
Learned counsel places heavy reliance on the reported judgment of Hon'ble High Court of Judicature Andhra Pradesh at Hyderabad in case of Union of India Vs. Aggala Dilleswara Rao and Hon'ble High Court of Madhya Pradesh in case of Union of India Vs. Satish Patidar & Anr. He further submits that in view of the ratio laid down by the different High Courts, the claimant is not entitled for any amount. However, on query made by this Court regarding impact of beneficiary legislation retrospectively, learned counsel seeks sometime.
