04/ 18.11.2022 Learned counsel appearing for the petitioner shall array the informant as O.P. No. 2 in course of the day.

Mr. Sidhartha Roy, learned counsel appearing for the petitioner submits that on 18.03.2022, the informant brought his son in the hospital of the petitioner, who is a doctor. He submits that the son of the informant was having the neuro problem, that's why he was admitted and treatment was provided, however, after 10 days, in spite of his best efforts, the son of the petitioner has not been saved. He further submits that the petitioner is a practicing doctor and running the hospital in the name of Rani Children Hospital, Ranchi, however, maliciously the case has been lodged against him, under Sections 304-A, 417 and 420 of the Indian Penal Code. He further submits that the case of the petitioner is fully covered by the judgment of the Hon'ble Supreme Court in the case of Jacob Mathew Versus State of Punjab & Ors., reported in (2005) 6 SCC 1.

Let notice be issued upon the newly added O.P. No. 2 under registered cover with A/D as well as by ordinary process, for which, requisites etc. must be filed within two weeks.

No coercive steps shall be taken against the petitioner, in connection with Kotwali P.S. Case No. 71 of 2022, pending in the court of learned C.J.M., Ranchi, till the next date of listing.

Let this matter appear on 23.03.2023.

Mr. Vashistha, learned Spl.P.P. appearing for the State shall also assist the court on the law point on the next date of listing.
