CORAM : HON'BLE MR. JUSTICE DR. S.N. PATHAK
------
For the Petitioner : Mr. Pandey Neeraj Rai, Advocate For the Respondents : Mr. Sreenu Garapati, Advocate For the Resp.-JMMDC : Mr. Manoj Kumar, Advocate
-----
22/ 23.06.2022 Heard the learned counsel for the parties.
Learned counsel for the petitioner submits that the issue involved in these writ petitions are squarely covered by the judgment passed by this Court in the case Anirudh Kumar Gupta & Ors. Vs. Jharkhand State Mineral Development Corporation Ltd., in W.P.(S) No. 2156 of 2015. It has further been argued that even the cases of the present petitioners are on better footing.
Mr. Manoj Kumar, learned counsel representing the respondent JMMDC submits that an enquiry is pending and only after outcome of enquiry, he will in a position to state as to what benefits may be given to the petitioners or whether they are entitled for regularization or not.
As, it has been clearly observed at para-16 of the judgment that even some enquiry is pending, the petitioners cannot be deprived of the benefits, this Court fails to understand as to whether the enquiry report is of any help of the respondents.
However, since learned counsel appearing for the respondents prays for some time, prayer is allowed.
Put up this case on 11.08.2022.
(Dr. S. N. Pathak, J.)
