2/ 06.07.2022 The petitioner has assailed the order dated 30.10.2021, whereby, show cause notice was issued asking the petitioner as to why his services be not terminated on the ground that he does not fulfill the requisite qualification.

At the very outset, Mr. Om Prakash Tiwari, learned G.P.-II, appearing for the respondents raises preliminary objection of maintainability. Learned counsel submits that the writ petition is itself not maintainable in view of the celebrated judgment of the Hon'ble Apex Court in the case of Union of India & Anr. Vs. Kunisetty Satyanarayana, reported in (2006) 12 SCC 28.

Since no counter affidavit has been filed, the respondent State is directed to file the same within two weeks.
