1. Appellant is aggrieved of judgment dated 11.09.2025, passed by learned

Special Judge Anti Corruption, CBI Cases, Jammu ["trial Court"], vide which he

came to be convicted and sentenced to undergo simple imprisonment of one year

and fine of Rs. 50,000/- for offence under section 5(2) of Prevention of

Corruption Act, six months and fine of Rs. 5,000/- under section 419 RPC, one

year and fine of Rs. 50,000/- under section 420 RPC, one year and fine of Rs.

50,000/- under section 467 RPC, one year and fine of Rs. 50,000/- under section

468 RPC, six months and fine of Rs. 5,000/- under section 471 RPC and six

months and fine of Rs. 10,000/- under section 120-B RPC, with the stipulation

that all the sentences shall run concurrently.

2. The appellant has assailed the impugned judgment on various grounds

urged in the memo of appeal, which requires a thorough consideration, having

regard to the trial court record.

4. Ms. Monika Kohli, learned Sr.AAG waives notice on behalf of the

respondent.

5. Learned counsel for the appellant has filed an application, CrlM No.

1868/2025, for placing on record report of the Medical Board, a perusal whereof

reveals that appellant, who is 84 years of age, is suffering with various ailments.

6. Learned senior counsel appearing for the appellant has submitted that

appellant has been hospitalized for treatment.

7. Ms. Monika Kohli, learned Sr.AAG though confirmed that appellant is

hospitalized in Government Medical College, Jammu, but vehemently opposed

the suspension of sentence and grant of bail.

8. Send for the trial court record.

9. List on 28.11.2025.

10. Meanwhile, having regard to the exceptional circumstances of the case, in

particular advanced age and medical condition of the appellant, the impugned

order of sentence is suspended and appellant is admitted to bail on his furnishing

of surety bonds to the tune of Rs. 1,00,000/- to the satisfaction of learned

Registrar Judicial of this Court and a bond of personal recognizance of the like

amount, subject to the satisfaction of Superintendent of the Jail concerned, subject

to the condition that he shall remain present in this Court.

11. Application CrlM No. 1868/2025 is disposed of.

12. Copy of order be furnished to learned counsel for the appellant under the

seal and signature of Bench Secretary of this Court.
