The matter is taken out of turn on mention. It is submitted by the learned counsel for the petitioners that para 10 of the statement of facts/compliance report dated 30.09.2025, filed on behalf of the respondents, appears to be apparently contemptuous, for which, the rule needs to be framed against the respondents.
It is revealed from the perusal of the record that in response to the judgment of this Court dated 22.09.2023, whereby the respondents/SMC Authorities were directed to proceed in the matter expeditiously under and in terms of the report dated 17.11.2020 submitted by Composite Officer, SMC, without any fail, have submitted in the statement of facts in para 10 that the issue can be mutually solved by settlement in between the shareholders.
The respondents 2 to 4 are directed to remain personally present before this Court on the next date of hearing to explain the averments of their statement of facts dated 30.09.2025, so that further proceedings are initiated in the matter.
