Coram:
Hon'ble Mr. Justice Sanjay Dhar, Judge
                             ORDER

07.05.2025 Learned counsel for the respondent/contemnor has submitted that the orders for disbursement of the salary/arrears in favour of 7 petitioners stand already issued. He has produced copies of the Communications dated 06.05.2025 to support his assertion.

Learned Senior Counsel appearing for the petitioner does not dispute this position. However, he has submitted that the writ petition in which order sought to be implemented has been passed, was filed by 7 petitioners for and on behalf of the employees of JK Cements Limited and not in their individual capacities. A perusal of the order of the writ Court dated 05.07.2022, confirms this position. It is clearly indicated in the said order, that petition has been filed for and on behalf of the employees of JK Cements Limited.

In this view of the above, release of arrears of salary in favour of only 7 employees would not constitute compliance of the judgment of the writ Court. Respondents are, therefore, directed to implement the judgment of the writ Court in respect of other employees of JK Cements Limited as well and file a compliance report in this regard by next date of hearing.

List on 16.07.2025.
