Mr. K. S. Johal, learned senior counsel accepts notice on behalf of the

respondent.

The petitioner came to be convicted and sentenced to simple

imprisonment for a period of one year with compensation of Rs.6.00 lacs

payable to the respondents, vide judgment dated 14.03.2017 passed by the

learned Judicial Magistrate 1st Class (City Judge), Jammu ["the trial Court"] in

File No.64/complaint. This judgment came to be upheld by the appellate court

vide judgment dated 31.07.2025.

The petitioner seeks suspension of the sentence by virtue of the present

application. Learned counsel for the appellant has raised arguable issues in the

present appeal, which needs a detailed consideration and it is likely to take some

time.

In the aforesaid circumstances, the present application is allowed and the

execution of impugned sentence is suspended. As a consequence, the petitioner

is admitted to bail on his furnishing a surety bond in the amount of Rs. 25,000/-

to the satisfaction of learned Registrar Judicial of this Court and a bond of

personal recognizance in the like amount subject to the satisfaction of the

Superintendent of the concerned Jail and subject to the deposit of 50% of the

cheque amount in the Registry within a period of fifteen days from today.

Application is, accordingly, disposed of.
