04.10.2023 Through the medium of instant petition, the petitioner is seeking
implementation of order dated 14.02.2011 passed by the writ court, whereby the
respondents were directed to accord consideration to release the amount deposited in
the GP Fund Account of the petitioner along with interest within eight weeks.
The respondents have filed the compliance report in which it has been
submitted that SRO 254 of 2008 dated 02.09.2008 which provides for payment of
interest upto two years, is not applicable to the case of the petitioner because he has
retired from service on 31.10.2004 i.e approximately four years before coming into
force of the said SRO. According to the respondents, claim of the petitioner for grant
of interest upon GP Fund beyond six months is not permissible. Accordingly, the
respondents have after considering the claim of the petitioner rejected the same.
In view of the above, the judgment of the writ court stands complied with,
as such, no case for proceeding against the respondents is made out. The contempt
proceedings are closed.
