The instant contempt petition has been preferred by the petitioner for seeking implementation of the order/judgment passed by this Court on 27th April 2023 in WP(C) No. 1743/2021, whereby Respondent No. 1 was commanded to accord effective consideration to the case of the petitioner for appointment on compassionate grounds, having been acknowledged, endorsed and recommended by Respondents 2 and 3 and consequently, a direction was issued to the respondents to offer the said compassionate appointment to the petitioner on the same analogy as has been done in case of Ghulam Mohammad Wani, within a period of eight weeks from the date a copy of the said order/judgement was served by petitioner upon the respondents.
Mr. Sami Sabir Lone, the learned counsel appearing on behalf of petitioner submits that the order/judgment has since been served to the respondents but till date, the order/judgment has not been complied with.
On the asking of the Court, Mr. Jehangir Ahmad Dar, the learned Government Advocate caused his appearance on behalf of the respondents and assures the Court that the order/judgment passed by this Court will be implemented in its letter and spirit.
In the light of the aforesaid assurance extended by the learned counsel for the respondents, the instant contempt petition is disposed of at this stage by directing the respondents to accord effective consideration to the case of the petitioner strictly in conformity with the order/judgment passed by this Court on 27th April 2023 in WP(C) No. 1743/2021, within a period of four weeks from the date a copy of this Order along with copy of contempt petition and the writ petition, are made available to the respondents and the order of consideration which is likely to be passed, be provided to the petitioner through registered post. It is made clear that in the event the order/judgement supra passed by this Court is not complied, within the aforesaid period, the petitioner shall be at liberty to seek revival of the contempt petition and in that eventuality, the Court will be constrained to take coercive measures against the respondents.
Contempt petition shall stand disposed of.
