The delay in filing this appeal was condoned vide order dated

19.07.2017.

Mr. D S Saini, learned counsel for the respondents submits that the

Limitation Act is applicable to the proceedings under Hindu Marriage

Act, 1980 in terms of the judgment of this Court in Sarishta Devi v.

Omkar Lal, reported at 1981 Legal Eagle (J&K) 54.

In view of the aforesaid, let this petition be listed before the same

Bench which condoned the delay.

Meanwhile, applicant is directed to deposit the amount of

maintenance awarded in terms of order dated 29.03.2017 by the next

date.
