There is delay of 38 days in filing the appeal, which has been sufficiently explained. Learned counsel for the respondents submits that he has no objection in case delay in filing the appeal is condoned. As such, application seeking condonation of delay is allowed.

SLA No. 09 of 2016

This is an application seeking leave to file appeal against judgment and order of acquittal dated 23.09.2015 passed by the learned Principal Sessions Judge, Udhampur.

Having regard to the submissions made by the learned counsel for the applicant, a case for grant of leave to file appeal is made out. The application is allowed and the applicant is granted leave to file appeal against the impugned judgment.

The appeal be diarized and be posted for admission on 30.09.2021.
