ORDER
In terms of judgment dated 29.07.2020 passed in a bunch of petitions,
led by SWP No. 688/20069 titled 'Dr. Om Kumar and ors vs. State and ors', a
Robekar was framed against the respondents and they were put to notice.
Mr. Siddiqui, learned Sr. AAG and Mr. F.A Natnoo, learned AAG
representing the respondents have brought it to the notice of this Court that the
aforesaid judgment was assailed by the UT of Jammu and Kashmir before the
Division Bench in LPA No.102/2020 which was disposed of on 10.02.2021
and the impugned judgment to the extent of paragraph Nos. 30, 41 & 42 has
been set aside. Copy of the judgment of Division Bench has been placed on
record.
In view of the aforesaid, the basis of initiation of Suo Motu Contempt
proceedings i.e., the observations of the Writ Court in Paragraph Nos. 30,41,
and 42 of its judgment have ceased to exist and, therefore, proceedings in this
contempt petition are closed.
