Learned counsel for the petitioner submits that the petition be treated as the petition only under Section 227 of the Constitution of India. It is treated as such.

The petitioner is aggrieved of the order dated 07.09.2021 by virtue of which the court of Sub-Judge, Baramulla, hereinafter referred to as the trial court, while placing reliance on the judgment titled Asia Resurfacing of Road Agency Pvt. Ltd. v. Central Bureau of Investigation, has kept the order of status quo in abeyance.

Prima facie case for indulgence is made out.

Notice to the other side returnable within four weeks for filing objections. In the meanwhile, till next date and subject to objections of other side, status qua as on date be maintained on spot.
