                                 ORDER

Petitioner is complaining about the non-implementation of the judgment/order dated 16.08.2013 passed in SWP No.864/2013 read with judgment/order dated 18.03.2009 passed in SWP No. 329/1996.

Vide aforesaid judgment/order, Writ Court directed the respondents to consider the case of the petitioner for regularization as per the rules applicable. It seems that the respondents after considering the case of the petitioner declined to regularize his services and Government Order No. 508-HME of 2014 dated 22.08.2014 was passed. However, this Court upon consideration of the said order and compliance report vide order dated 31.08.2015 observed that the compliance report is not acceptable as the same is not in conformity with the directions of the Writ Court. Respondents were directed to pass a fresh consideration order with regard to claim of the petitioner. However, since then the respondents have been taking time to pass a fresh consideration order, and till date nothing has come out.

Mr. Irfan Andleeb, learned Dy. AG, submits that the matter pertains to Health and Medical Education Department and after the recent change of the Law Officers, the instant case has not been assigned to any Law Officer as yet. He seeks some time to file fresh compliance report/statement of facts. Time is allowed.

Respondents shall also file their statement of facts as regards the payment of wages of the petitioner.
