Petitioner is alleging violation of final order/Judgment passed on

15.02.2019 in LPA No. 127/2016, in terms whereof the respondents were

directed to go ahead with the finalization of the panel originally prepared by

respondents 3 and 4 on the basis of revenue village Rakhi Sultanpora and offer

the engagement to the petitioner-Javeed Ahmad Bhat.

In this petition, notice was issued to respondents on 31.07.2019, and the

respondents on 24.12.2019, appeared and sought time to file statement of

facts/compliance. For more than two and a half years, the respondents are not

implementing the final order/Judgment and vide order passed on 28.10.2021,

on recording the statement of counsel appearing for the respondents that the

matter for creation of a post on which the petitioner could be adjusted in terms of the order dated 15.02.2019 has been placed before the Chief Secretary,

sought and was granted time to submit the action taken report. Again in terms

of order dated 09.11.2021, one months' further time was granted to file the

response, which was further extended on 15.12.2021 by ten days.

The Commissioner Secretary to Government, School Education

Department has to submit the compliance otherwise, the Court will have no

option but to frame Rule against him.

In the above background, we feel it necessary to seek personal

appearance of the Commissioner Secretary to Government, School Education

Department, on the next date of hearing along with compliance. In the event

compliance is submitted by or before the next date, the above mentioned

officer need not to appear on the next date of hearing.
