Learned counsel for the applicant-petitioner
stated that 50% of the cheque amount has been deposited
by the applicant, i.e. a sum of Rs.37,500/- deposited in the
trial Court on 12.07.2022 and a sum of Rs.22,500/-
deposited in the Registry of this Court on 28.09.2023.
Heard.
As the main case is pending adjudication, it is
ordered that the substantive sentence imposed upon the
applicant-petitioner, vide judgment of conviction dated
22.04.2022 and order of sentence 09.05.2022, passed by
the learned Judicial Magistrate First Class, Court No.4,
Shimla, H.P., and affirmed by learned Additional Sessions
Judge (I), Shimla, District Shimla, H.P., vide judgment dated
26.09.2022, shall remain suspended, till final disposal of the
petition, however, subject to the applicant's furnishing
personal bond in the sum of Rs.25,000/- with one surety in
the like amount to the satisfaction of learned trial Court,
within a period of four weeks from today, undertaking
therein to appear in the Court as and when directed and in
the event of the dismissal of the petition, the applicant will
.
surrender before the Court to undergo sentence, if any,
imposed by the Court.
The application stands disposed of.
