By way of instant application filed under Section 5 of the Limitation Act, prayer has been made on behalf of the applicants/appellants for condonation of delay in filing the

accompanying appeal, which is barred by limitation.

Mr. Virender Thakur, Learned counsel for the non-

applicants/respondents while inviting attention of this court under Section 74 of the Right to Fair Compensation and

Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, states that this Court has no power to

the condone the delay beyond 120 days and as such present application deserves outright rejection. In support of aforesaid contention, Mr. Thakur invited attention of this Court to the judgment dated 25.9.2019, passed by the High Court of Karnataka at Bengaluru, in case titled The Deputy Commissioner v. M/s SV. Global Mill Ltd., wherein aforesaid issue has been elaborately dealt with.

Having perused aforesaid judgment passed by the Karnataka High Court, learned Additional Advocate General prays for is granted two days time to have instructions. List on 19.10.2022.
