CMP No.14272 of 2022 in

RFA No.257 of 2010 15.10.2022 Present Mr. T.S.Chauhan, Advocate, for the non-applicant-

appellant.

Mr. Bodh Raj, Advocate vice Mr. G.R.Palsra, Advocate, for the applicants/respondents.

By way of instant application, prayer has been made on

behalf of applicant/respondent No.2 for release of the award

amount lying deposited in the Registry of this Court. No reply is

intended to be filed on behalf of the non-applicant-appellant.

Learned counsel representing the non-applicant-

appellant fairly states that appeal bearing RFA No.257 of 2010,

having been filed by the non-applicant/appellant, stands finally

decided vide judgment dated 30.10.2017 passed by Co-ordinate

Bench of this Court in bunch of appeal including RFA No.257 of

2010 along with connected matters. He states that since none of

the parties have laid challenge to aforesaid judgment in the superior

court of law, same has attained finality and as such, prayer made in

the instant application can be allowed.

Having taken note of the aforesaid fair statement made

by learned counsel for the non-applicant-appellant, coupled with the

fact that judgment dated 30.10.2017 passed by Co-ordinate Bench

of this Court has attained finality, there appears to be no

impediment in accepting the prayer made in the application.

Consequently, in view of the above, the present

application is allowed and Registry is directed to release the award

amount alongwith upto date interest in favour of applicant/

respondent No.2, strictly as per his share, by remitting the same in

his saving bank accounts, details whereof are given in para-2 of the

.

application, subject to the verification by the Accounts Branch.

Registry while complying with the instant order would call upon the

applicant/respondent No.2 to furnish his Adhar Cards to establish

his identity. The Application stands disposed of.
