2021 Latest Caselaw 545 HP

Citation : 2021 Latest Caselaw 545 HP
Judgement Date : 8 January, 2021

Himachal Pradesh High Court
CMP-T/2156/2020 on 8 January, 2021
Bench: Sandeep Sharma

CMP-T No. 2156 of 2020 in COPC-T No. 1137 of 2020

8.1.2021 Present: Mr. Sanjay Bhardwaj, Advocate, for the petitioner.

Mr. Inder Sharma, Advocate, for the respondent.

.

Through Video Conferencing

Mr. Inder Sharma, learned counsel for the respondent,

has placed on record copy of order dated 7.1.2021, passed by Dr.

Yashwant Singh Parmar University of Horticulture and Forestry, Nauni

(Solan), in purported compliance of order dated 1.7.2019, passed by

the Erstwhile HP State Administrative Tribunal in OA No. 1316 of 2018,

further upheld vide judgment dated 28.12.2020, passed by the

Division Bench of this Court in CWP No. 3563 of 2020, perusal whereof

clearly reveals that the respondent while withdrawing office No. UHF/

Regr. Rectt. 2-15/2018-39552-65 dated 6.1.2021 has passed fresh

order of appointment and posting of the petitioner against the post

of Jr. Office Assistant (IT) in the pay scale of Rs.5910-20200+1950 GP at

THRS, Kotkhai, District Shimla and his salary would be drawn against

the vacant post at COH&F, Thunag (Mandi) under Scheme HPL-056-

64, with all consequential benefits subject to the outcome of the SLP

intended to be filed in the Hon'ble Apex Court. Copy of aforesaid

order is taken on record.

Having perused aforesaid order, Mr. Sanjay Bhardwaj,

learned counsel for the petitioner, fairly states that order alleged to

have been violated stands duly complied with, but necessary

directions may be issued to the respondent-University to pay the

consequential benefits in a time bound manner.

Consequently in view of the aforesaid order dated

7.1.2021, passed by the respondent, there appears to be no reason

to keep the present contempt application alive and accordingly,

same is disposed of. Notices are discharged. Since petitioner has

been contesting the case at hand for the last more than six years

and judgment in his favour was passed in the year, 2019, this Court

hopes and trusts that respondent-University would release the

.

consequential benefits, expeditiously, preferably, within a period of

six weeks.
