Heard.

Substantive sentenced imposed upon the petitioner

vide judgment dated 24.10.2019, passed by learned Chief

Judicial Magistrate, Shimla in RBT case No.223­3 of 18/14

titled as Nirmal Kumar Vs. Devinder Singh affirmed by

the learned Sessions Judge, vide judgment dated 25.02.2021,

passed in Criminal Appeal No.34/S­10 of 2019 titled

Devinder Singh Vs. Nirmal Kumar, is suspended during

the pendency of the petition, subject to petitioner furnishing

personal bond in the sum of Rs.35,000/­ with one surety in the

like amount to the satisfaction of the Trial Court within four

weeks from today, undertaking therein to appear before this

Court as and when directed and to surrender to serve out the

sentence imposed in case his revision petition is ultimately

dismissed, and also subject to deposit of entire compensation

amount in the Registry of this Court, after deducting the

amount, if any, deposited in the Trial Court during the

pendency of the appeal before learned Sessions Judge.

Bail bonds so furnished by the petitioner shall be

transmitted by learned Trial Court to the Registry of this

Court for placing the same on record alongwith detail of the

amount if any deposited by the petitioner in the trial Court.

Alteration/vacation/modification on motion. Non­

compliance of order shall result into automatic vacation of

interim protection. Application stands disposed of.
