                               ORAL ORDER

1. By this application, the applicant has prayed for condoning the delay of 99 days caused in preferring the captioned civil revision application.

2. Mr.SM Kikani, learned advocate for the applicant submitted that some time got consumed in getting the certified copy of the judgment and decree and thereafter, the learned Advocate, was approached and after taking necessary steps, collecting, drafting and finalizing the appeal that the appeal could be filed. As a result whereof, some time got consumed culminating into delay of 99 days. It is urged that the delay is bona fide which may kindly be condoned.

3. Heard Mr. SM Kikani, learned Advocate appearing for the applicant and Mr. Dhruv Dave, learned Advocate appearing for the respondent.

4. Having regard to the averments made so also the oral submissions and considering the length of delay and explanation offered, this Court, is of the opinion that delay of 99 days caused in filing the captioned appeal deserves to be condoned and is hereby condoned.

5. Civil application succeeds and is accordingly allowed. Rule is made absolute. No order as to costs.
