CORAM:HONOURABLE MR. JUSTICE NIRZAR S. DESAI

                                 Date : 19/01/2024

                                  ORAL ORDER

Rule. Learned APP Ms. Mathili Metha waives service on behalf of the respondent State.

2. By way of this application for successive bail the applicant is seeking regular bail in connection with FIR, being C.R No. 11193013210218 of 2021 registered with Chalala Police Station for the offences punishable under Sections 302, 120(B) and 34 of the Indian Penal Code.

3. It is pointed out by learned advocate Mr. N.P Pandya, that vide order dated 10.3.2023 while withdrawing the earlier bail application being Criminal Misc. Application No. 21667 of 2022, this Court had

granted liberty to the applicant to apply afresh if the trial does not get over by 30.9.2023 and therefore, this Successive bail application is preferred.

4. Upon a query from this Court, learned advocate Mr. N.P Pandya states that though the trial is not concluded the same is at the stage of final argument.

5. In view of above, as the stage of evidence is over and the trial is at the stage of final argument, I do not find any reason to entertain this application and therefore, the same is dismissed accordingly. Rule is discharged.

6. However, learned Trial Judge is requested to conclude the trial at the earliest and pronounce the judgment.
