1. Rule. Learned APP waives service of notice of Rule for the respondent-State.

2. The Present petition is filed by the petitioner seeking judgment of an FIR against the accused.

3. Heard learned advocates for the respective parties.

4. Learned APP vehemently opposes the present petition, arguing that the petitioner has directly approached this Court without considering the representation that was addressed to respondent Nos. 3 and 4. Therefore, the application may be dismissed.

5. It appears from the record that a representation dated 05.10.2022 has been addressed to respondent No.2, Police Inspector, Khambhat Rural Police Station, Anand. Subsequently,

the petitioner gave a representation to respondent Nos. 3 and 4 on 19.01.2023, but the same has not been heard yet. Therefore, she approached this Court to lodge an FIR.

6. In view of the above, respondent authority is directed to consider the representations of the petitioner and inform about the outcome of the same within four weeks.

7. With the aforesaid direction the petition stands disposed of. Rule is made absolute to the aforesaid extent. Direct service is permitted.

8. However, it is clarified that this Court has not gone into the merits of the case.
