ORAL ORDER

(PER : HONOURABLE MR. JUSTICE ASHUTOSH SHASTRI)

1. The present contempt proceeding is initiated for alleged

willful disobedience of order dated 08.03.2022 passed by the

learned Single Judge in Special Civil Application No. 16299 of

2018.

2. When the matter is taken up for the hearing, learned

Assistant Government Pleader has placed on record an affidavit

of respondent no. 1 and has categorically stated that seniority of

C/MCA/198/2023 ORDER DATED: 27/04/2023

the applicant will be restored in due course subject to filing of

Letters Patent Appeal which the department may file. Since the

main petition i.e. Special Civil Application 25416 of 2022 came

to be allowed by judgment dated 12.04.2023, we deem it proper

to close the present proceedings. The said copy of the affidavit

is also served to Mr. G.M. Joshi, learned Senior Advocate

appearing for the applicant wherein a categorical assurance as

stated above is given.

In view of the aforesaid situation, we deem it proper to

close the contempt proceeding. Accordingly, contempt petition

stands disposed of. Notice is discharged.
