ORDER IN R/CRIMINAL MISC.APPLICATION NO. 4347 of 2023

1. Heard Mr. Arvind Thakur, learned advocate on record for the

applicant-original complainant, Mr. Chintan S. Popat, learned

advocate appearing for the respondent Nos.2 to 6 and Ms. Chetna M.

Shah, learned APP appearing for the respondent-State.

2. This is an application filed under Section 5 of the Limitation Act,

praying for condonation of delay of 7 days, caused in filing the criminal

R/CR.MA/4347/2023 ORDER DATED: 10/04/2023

appeal against the judgment and order of acquittal dated 11.01.2022

passed by the learned Principal District & Sessions Judge, Gir Somnath

at Veraval in Sessions Case No.07 of 2021.

3. Mr. Arvind Thakur, learned advocate on record for the

applicant-original complainant, has invited attention of this Court to

the averments made in the application and urged this Court to

condone the delay.

4. Considering the submissions made by learned advocates

appearing for the respective parties and considering the meager

number of days of delay of 7 days, present application for

condonation of delay stands allowed. Rule is made absolute.
