This is an application under Section 5 of Limitation Act to condone the delay of 324 days which has occurred in preferring an appeal to assail the judgment and award of the reference Court.

Having considered the submissions and the averments made in the present application. It is a fit case to condone the delay accordingly.

Hence, the present application is allowed. The delay of 324 days which has occurred in preferring an appeal is condoned. Rule is made absolute.
