ORAL ORDER

IN APPLICATION By way of present Criminal Misc. Application u/s 378(4) of the Code of Criminal Procedure, the applicant CBI seeks leave to challenge judgment and order of acquittal dated 10.5.2021 passed by the learned Special Judge, CBI Court No.4, Ahmedabad in CBI Criminal Appeal No.2/2016 to 4/2016 arising out of Criminal Case No.98/2004 in RC36(S)/1997 u/s 120-B, 380, 420, 467, 468, 471 and 193 r/w section 195 of the IPC, whereby the appeal Court quashed and set aside the conviction order passed by the learned Addl. CJM, CBI Court No.2, Ahmedabad in Criminal Case No.98 of 2004 qua present respondent Nos.1 to 3.

We have heard learned advocate Mr. RC Kodekar for the applicant - CBI and upon perusal of the impugned judgment and considering the reassessment and reanalysis of evidence at a glance, we are of the considered opinion that present Criminal Misc. Application deserves consideration and accordingly it is allowed.

ORAL ORDER IN APPEAL

Admit. Bailable warrant in the sum of Rs.15,000/- be issued qua original respondents. Learned APP waives service of notice of admission for the respondent State.
