Heard Mr. Mr. S. Abdullah, learned counsel appearing for the applicant.

Also heard Mr. B.D. Chowdhury, learned counsel appearing for the respondent

No. 2.

This is an application filed under Section 5 of the Limitation Act for

condoning the delay of 84 days in preferring the connected Criminal Revision

Petition against the order dated 31.05.2024 passed by the learned Sessions

Judge, Baksa in Criminal Appeal Case No. 10/2023.

Mr. S. Abdullah submits that the grounds of delay are genuine grounds as

he has explained the same in Paragraph 3 of the instant petition. In the said

paragraph, it is stated that on receipt of the certified copy the said judgment

and order dated 31.05.2024, the applicant initially could not approach the

counsel due to illness of his mother and the same had caused the delay of 84

days.

Mr. B.D. Chowdhury fairly submits that the reasons mentioned in the said

petition have caused the said delay of 84 days and the same are found to be

genuine and as such, he has no objection if the delay is condoned for the ends

of justice.

In view of the reasons mentioned in the said petition, this Court finds it fit

that the delay of 84 days in preferring the connected Criminal Revision Petition

are caused on genuine grounds and the same may be condoned for the ends of

justice.

As such, the I.A. is disposed of.

The connected Criminal Revision Petition may be registered by the

Registry and be listed for admission.
