Heard Ms. S.B. Choudhury, learned counsel for the petitioner; Mr. D. Nath, learned Senior Government Advocate, Assam; and Mr. J. Handique, learned Standing Counsel, Revenue & Disaster Management Department.
2. The case of the petitioner is that their cases were recommended for appointment by the District Level Committee [DLC] for compassionate appointment. But, the respondent authorities in the showing a lackadaisical attitude, did not place the cases of the petitioner
before the State Level Committee [SLC] for compassionate appointment.
3. Mr. Nath, learned Senior Government Advocate appearing for the State respondents has submitted that in view of the Judgment and Order dated 03.04.2025 in W.P.[C] no. 342/2025, O.M. dated 18.09.2024, notice dated 30.08.2025 of the Personnel Department and an Executive Order dated 30.08.2025, there is restriction on the part of the respondent authorities for consideration of the cases of the petitioner.
4. In response, Ms. Choudhury, learned counsel for the petitioners has submitted that the cases of the petitioners is covered by the Judgment and 04.06.2025, passed by a coordinate bench in W.P.[C] no. 2888/2025.
5. The matter would require consideration.
6. The respondent authorities shall file their respective counter affidavits without fail on or before 22.10.2025.
7. List the case on 22.10.2025.
