Heard Mr. G. Choudhury, learned counsel for the applicant. Also heard Ms. N. Das, learned Addl.P.P. for the State respondent.

This application, u/s 5 of the Limitation Act is preferred by the applicant, Sri Jayanta Bora for condonation of delay of 67 days in preferring the Criminal Revision Petition against the judgment and order dated 12.4.2022, passed by the learned Sessions Judge, Nagaon in Crl. Appeal No. 77/2019. It is to noted herein that vide impugned order, the learned Court below has upheld the judgment and order of conviction and sentence dated 9.9.2019, passed by the learned Chief Judicial Magistrate, Nagaon in NI Case No. 68/2016.

Perused the petition and grounds mentioned therein. Let notice be issued to the respondent No.2 returnable in four weeks. Steps be taken upon respondent No.2 by registered post and also by usual process within a week from today However, no formal notice is required to be issued to respondent No.1, since Ms.N. Das, learned Addl. P.P. appeared and accepted notice. List after four weeks.
