Heard learned counsel for the parties.

This is an application filed under Section 439 Cr.P.C. praying for granting regular bail to the petitioner, Wajid Hussain @ Munna, who was arrested on 01.09.2023 in connection with Tinsukia PS case No. 518/2023 corresponding to POCSO case No. 115/2023.

It is submitted that the petitioner has been charge-sheeted in Tinsukia PS case No. 518/2023 under Charge-sheet No. 441/2023 corresponding to Special Case No. 115/2023 pending before the learned Additional Session Judge cum Special Judge, POCSO, Tinsukia.

Issue notice, returnable 11.12.2023.

Mr. K.K. Parasar, learned Additional PP, Assam accepts notice on behalf of respondent No. 1. Petitioner to take steps for issuance of notice upon the respondent No. 2. Notice be served through the O/C, Tinsukia PS .

Registry to do the needful for issuance of notice in terms of the judgment passed by the Hon'ble Division Bench in Crl. A (J)/ 40/2022 and the learned counsel for the petitioner shall furnish the requisite copies as necessary.

Registry is also to call for the scanned copies of the proceeding of POCSO case No. 115/2023 along with scanned copy of the case diary of Tinsukia PS case No. 518/2023.
