Heard Mr. A. Mannaf, learned counsel for the petitioner. Also heard Mr. M.P. Goswami, learned Additional Public Prosecutor for the State/respondent no.

This is an application under Section 397 r/w Section 401 Cr.P.C. against the Judgment and Order dated 03.10.2023 passed by the learned Additional Chief Judicial Magistrate, Karimganj in Misc. Case no. 118(A)/2020.

Issue notice.

The learned counsel for the petitioner is directed to take steps for service of notice upon the respondent No. 2 by way of registered post with A/D as well as by usual process returnable within 4 (four) weeks. The steps be taken within 7 (seven) days.

No formal notice required to be served upon the respondent No. 1 as because Mr. Goswami, learned Additional Public Prosecutor has entered appearance.
