Heard Mr. M. Ahmed, learned counsel for the appellant as well as Mr. B. Sarma, learned Addl. P.P., Assam appearing for the State respondent.

This appeal u/s 374 Cr.P.C. has been preferred against the impugned Judgment and Order, dated 10.01.2023, passed by the learned Special Judge Page No.# 2/2

(NDPS Act), Morigaon in NDPS Case No. 15/2022 (Arising out of Laharighat P.S. Case No.916/2021) convicting the accused u/s 21(b)/25 of the NDPS Act and sentencing to undergo R.I. for 4(four) years with fine of Rs.20,000/-, in default, to undergo S.I. for 1 year.

This appeal is admitted.
