Heard Mrs. R. Choudhury, learned counsel for the applicant. Also heard Mr. K.K. Das, learned Additional Public Prosecutor for the State Respondent.

This application under Section 5 of the Limitation Act, 1963 is Page No.# 2/2

preferred by the applicant Aminul Islam Barlaskar @ Munna for condonation of delay of 88 days in preferring the connected criminal revision petition against the judgment and order dated 29.3.2022 passed by the leaned Additional Sessions Judge, FTC, Cachar, Silchar in Criminal Appeal No.21/2020 whereby the appeal preferred by the present applicant assailing the Judgment dated 11.3.2020 passed in CR (DV) Case No.448 of 2013 has been dismissed with cost of Rs.5000/-.

Perused the petition and the grounds mentioned therein.

Let notice be issued upon the respondents returnable on 2.11.2022.

Steps be taken by registered post with A/D as well as under usual process, within a week from today.

No formal notice is required to be issued upon Respondent No.1 since Mr. K.K. Das, learned Additional Public Prosecutor has entered appearance on behalf of the said respondent.

However, extra requisite copy of the petition be furnished upon the learned counsel for the Respondent No.1 during the course of the day.
